Ensuring the rights of persons granted conditional parole

Abstract

Provisions on conditions and procedures for conditionnal parole have been currently included into the 2015 Criminal Code and the 2015 Criminal Procedural Code. The implementation of conditional parole and the rights of persons granted contional parole have just been detailed in the draft Law on amendment and supplementation of some articles of the 2010 Law on enforcement of criminal judgments. To give comments on the draft Law for improving the related legal provisions and ensuring the legitimate rights and interests of persons granted condtional parole, the paper offers some recommendations for amending and supplementing the 2010 Law on enforcement of criminal judgments in regard to: the rights of persons granted condtional parole; the time to consider granting conditional parole; the place of residence of persons granted conditional parole; and the responsibility of people’s procuracies for esnsuring the rights of persons granted conditional parole.
