Solutions to enhance the efficiency of judicial expertise in environmental management and protection
Abstract
Judicial expertise assumes a pivotal function in supporting environmental management and protection, as it not only helps detect violations of environmental laws, but also provides precise scientific data, thereby establishing a robust foundation for legal decisions and the development of effective environmental policies such as the Law on Judicial Expertise 2012, the Law on Environmental Protection 2020, and related guiding documents. Judicial expertise is instrumental in evaluating pollution levels, addressing violations, and proposing remedial measures. This paper emphasizes the significance of environmental impact assessment, sustainable resource utilization, and the implementation of technical standards in environmental management. Nevertheless, the current situation reveals deficiencies within the legal framework, limitations in technical capacity, lack of data synchronization, and insufficient community engagement, all of which impede the efficacy of judicial expertise. To address these challenges, this article proposes several solutions, including updating the legal system, establishing a comprehensive environmental database, enhancing human resources, investing in advanced technological equipment, facilitating community engagement, international cooperation, and the enforcement of rigorous monitoring and sanctioning mechanisms. These proposed solutions aim to elevate the quality of judicial expertise, protect natural resources, and promote sustainable development.
