LAND PROBLEM IN THE 1992 CONSTITUTION

Abstract

Based on  the analysis and remarks the writer concludes that

(a) The land and natural resources, visible and invisible property of the country are the common ownership of the people from generations to generations.

(b) A theory often used as a basis on which to identifies the land ownership is to regard land as special but limited production tools, so it should belong to the entire people. Some share this opinion, arguing that a distinction should be made between land to be used as the production tools and land to be used for social daily life (living space); in other words land as production tools belongs to public ownership, while land for living spaace belong to the private owned.

(c) The fact that land is a special commodity lies in the handing of the issues concerning the political relationship beween Party-State and the people. The respect for the land ownership by the people is a precondition to ensure the people's rights to reside, to have houses and to work as stipulated in the Constitution./.
