Abstract

Vietnamese Tra fillet and Basa fish started to enter the US market since 1997. For their quality and reasonable prices they have been acceptable to the American customers. However the exports of Vietnamese catfish to the US are not as easy as expected. On June 28, 2002 the US catfish farmers Association CFA sued Vietnamese enterprises for dumping on Tra fillet and Basa fish to the US Department of Commerce and International Commerce Committee. Based on the updated documents the article presents both the systematic developments of the case and convincing arguments from Vietnamese sides to reject CFA’s lawsuit which aims to ask the US Department of Commerce and International Commerce Committee to impose the so-called anti-dumping tax on Vietnam as illegitimate and groundless. This is in fact aimed to strengthen protectionism, which runs counter to the principle of fair competition and free trade. The content of the article includes:
  • Definition of Catfish concept and Catfish exports to the US.
  • Development of the case related to the lawsuit against Vietnamese enterprises for the allege dumping on Vietnamese Tra fillet and Basafish in the US market.
  • The status of the exports of Tra and Basafish to the US market and the production of Catfish and Catfish market in the US.
  • Convincing arguments to reject CFA’s suing of Vietnamese enterprises on the latter’s alleged dumping on Tra-fillet and Basa - fish in the US market.
