APPLYING THE PRIVATE ENFORCEMENT AGAINST THE ABUSE OF DOMINANCE OR MONOPOLY

Abstract

This paper focuses on the analysis of the rationale for applying private enforcement against the abuse of dominance or monopoly. It clarifies the principles regulating the relationship between the court to hear the cases of abuse of dominance or monopoly and the executive agency to apply the public enforcement against the abuse of dominance or monopoly in order to maintain the fairness, reasonabless and efficiency. Also, the paper offers recommendations for recognising the aplication of private enforcement against the abuse of dominance or monopoly in Vietnam.
