INITIATING CRIMINAL CASES ON THE REQUEST OF THE VICTIM - DIFFICULTIES IN IMPLEMENTATION AND RECOMENDATIONS FOR OVERCOMING

Abstract

The paper analyses the difficulties of the 2015 Criminal Procedure Code in regard to initiation of criminal cases on the request of the victim on the basis of predicting practical  situations that might happen during the course of applying the related provisions such as: the case involving different victims among whom ones request to initiate the case whilst  others do not; the time when the request to initiate the case is withdrawn; the validity of the withdrawal of the case initiation at different times and etc. On that basis, the paper offers recommendations for correctly and effectively applying the related provisons of the Criminal Procedure Code.
