Recognition and enforcement of foreign arbitral awards in Vietnam under the 2015 Civil Procedure Code

Abstract

The paper analyses and clarifies the legal provisions on the recognition and enforcement of foreign arbitral awards in Vietnam under the 2015 Civil Procedure Code. Comparing those legal provisions with the international conventions to which Vietnam is a party, especially the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, the paper emphasises on the compatibilities of the 2015 Civil Procedure Code and the problems arising in the course of its implementation regarding the recognition and enforcement of foreign arbitral awards, and thereby suggests the directions for improvement.
