Abstract

Jurisdiction to hear criminal cases at first instance where the accused is a legal person is defined by the matter, the subject and the territory. Defining the jurisdiction to hear criminal cases where the accused is a legal person accords with  not only common legal provisions on jurisdiction to hear criminal cases where the accused is a person but also specific legal provisions applied to the accused who is a legal person.The later legal provisions are new to the criminal procedure law of Vietnam and thus they undeniably are in need of improvement.The paper analyses jurisdiction to hear criminal cases at first instance where the accused is a legal person and offers proposals for improving the criminal procedure law of Vietnam in this regard.
