IMPLEMENTATION OF THE PROVISIONS OF THE CONSTITUTION ON HUMAN RIGHTS IN CRIMINAL PROCEDURE IN VIETNAM

Abstract

Human rights in criminal procedure are seen as an important area of human rights. The international community and individual countries including Vietnam always are interested in recognising those rights in their law and ensuring them in practice. The paper analyses the legal provisions on human rights and protection of human rights under the 2013 Constitution and the 2015 Criminal Procedure Code. It offers an overview of the practical application of the law on human rights of judicial organs whose centre is the court system. It also points out some limitations of the protection of human rights in criminal procedure and thereby suggests some requirements and solutions to contribute to improving the law and strengthening the protection of human rights in the coming time.
