PERFORMING CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS UNDER THE 1980 VIENNA CONVENTION - COMPARING WITH THE LAW OF VIETNAM

Abstract

The implementation of the 1980 Vienna Convention has positively impacted on the improvement of the national law on sale of goods. The paper analyses and assesses some provisions on performing contracts for the international sale of goods of the 1980 Vienna Convention. It points out the conformity and inconformity of the law of Vietnam with those provisions, specifically the conformity and inconformity of the provisions of the 2005 Commercial Law on  place of delivery of goods, goods which are not appropriate to contracts, examination of goods and preservation of goods. On that basis, the paper proposes to amend and supplement some articles of the 2005 Commercial Law to make them compatible with the 1980 Vienna Convention.
