WELL-KNOWN TRADEMARKS AND PROTECTION OF WELL-KNOWN TRADEMARKS BY THE “DEFENSIVE MARK ” TOOL IN JAPAN

Abstract
Any country which aims at developing a knowledge ecomony in the era of the fourth industrial revolution must pay attention to trademark protection. Japan as a leading ecomony in the world has a very effective legal institution of well-known trademark protection. The paper studies the adjustment of the Japanese law on well-known trademarks and protection of well-known trade marks. On that basis, the paper offers an in-depth analysis on “defensive mark” – the tool that enterprises are allowed to use for protection of well-known trademarks under the law of Japan.
