Educational measures in reformatory institutions under the Criminal Code and some recommendations for improvement

Abstract

Educational measures in Reformatory Institutions is a judicial measure applicable to juveniles under the Vietnamese Criminal Code. Although this measure has been in place from the first Criminal Code to the current one, there are a few researches on the nature and grounds for the application of this measure. Additionally, the current regulations of Vietnam are not fully in line with the international standards on juvenile justice. In this paper, the author analyzes the nature of this measure, and compares the the regulations under the Vietnamese Criminal Code with international norms and standards on juvenile criminal justice. From that background the author provides some recommendations to amend the provisions of the Vietnamese Criminal Code 2015 (amended in 2017) on the principles of dealing with juvenile offenders and the grounds for applying this measure.
