Declaration of a person’s death under Vietnamese Civil law

Abstract

The declaration of a person’s death is an important content of the part on individual of the Civil Code. The decision on declaration of a dead person does not only takes effect on such person but also concern the legitimate rights and interests of relevant subjects. However, the provisions on declaration of a person’s death are still ambiguous which causes different opinions during the process of understanding and applying the law. This article focuses on analyzing the provisions on declaration of death, thus discuss several issues with an aim to supplement the current law and guarantee a general and effective application in practice.
