Legislative techniques in the Law on Enterprises 2020 – Current situation and recommendations

Abstract

The article presents theoretical issues and the current state of legislative techniques in the Law on Enterprises (2020), which clearly states the advantages, successes as well as shortcomings, and disadvantages of these techniques. In order to perfect the legislative technique of the Law on Enterprises (2020), the author makes recommendations on word use; on the structure of chapters, sections, articles, and clauses; on the full reference and appropriate application of legislative experiences of other countries; on adjusting the organisation and equal, uniform operation between different types of enterprises and agencies with the same functions in different types of enterprises; and on specific, clear, conflict-avoiding, feasible provisions in practise.
