Sole distributions and the provisions in Competition Law on sole distributions

Abstract

 

The article deals with provisions in the Commercial Law on sole distributions and analyses situations where legal provisions on competition could intervene in distributors’ businesses. The article notably identifies that the Competition Law has the potential to intervene in the process of establishing sole distributors, particularly through provisions on agreements restraining vertical competition. The analysis shows that the provisions on sole distributions in the Commercial Law need to reflect the intervention of the Competition Law as well as the potential to invoke these provisions within relationships of sole distributions.
