Laws on rights to establish representative organizations of employees at enterprises in some nations – Experience for Vietnam

Abstract

Representative organizations of employees are regulated in the 2019 Labor Code with a diversity of forms including trade unions and organizations of employees at enterprises (grassroots level). However, since this Code came into effect, no legal documents guiding the implementation has been issued, leading to a number of limitations in the implementation. This article assesses the legal provisions of some countries on the right of employees to form trade unions - representative organizations of employees at enterprises, in accordance with political, economic and social conditions in Vietnam to conclude reference values for our laws on the right to establish organizations of employees at enterprises.
