Provision on the protection of non-conventional trademark in some countries and experiences for Vietnam.

Abstract

In the world, the non-conventional trademark has been recognised and protected industrial property rights. While in Vietnam, although Intellectual Property Law 2005 - amended in 2009, 2019 (IP Law 2005) - referred to non-conventional signs such as holographic signs and color signs in protected trademark conditions, in the fact that there are some inadequacies in this protection. Based on the reference experiences of some countries and international laws, the article analysed and commented on the inadequacies of Vietnam law, thereby making some solutions to improve Vietnam Intellectual Property Law on trademark protection, including non-conventional trademarks.
