FURTHER DISCUSSIONS ON THE TECHNOLOGY NEUTRALITY PRINCIPLE AND IMPLICATIONS FOR THE REGULATION OF CRYPTO-ASSETS

Abstract

Abstract: Against the backdrop of the crypto-assets rapid growth and their 
gradual legal recognition in Vietnam, the need to refine the regulatory framework governing 
crypto-assets has become increasingly urgent. This article revisits the technology neutrality 
principle and examines its role in shaping legal frameworks for technology in general and 
crypto-assets in particular. A technology-neutral approach helps avoid extreme regulatory 
positions, strikes a balance between innovation and legal stability, enhances the legal system’ 
sustainability. Nevertheless, the disruptive nature of crypto-assets continues to challenge 
both the theoretical foundations and the practical implementation of technology neutrality in 
contemporary regulation.
