Abstract

Abstract:  In the context of Vietnam’s participation in new-generation FTAs, trade remedies 
remain a key legal tool to protect domestic industries. This article analyzes trade remedy 
commitments under the CPTPP and EVFTA in comparison with the WTO framework, highlighting 
“WTO+” elements, particularly in transparency and investigation procedures. Using doctrinal 
and comparative methods, the article assesses Vietnam’s implementation and identifies existing 
gaps. It then proposes legal recommendations to enhance the effective use of trade remedy 
instruments in the context of international economic integration.
