CƠ CHẾ KIỂM SOÁT QUYỀN LỰC NHẰM BẢO ĐẢM THỰC HIỆN QUYỀN CON NGƯỜI Ở VIỆT NAM HIỆN NAY

Abstract

In the context of ensuring and protecting human rights, power control mechanism means a system of (i) regulations on control over the use of state powers and the implementation of these regulations; (ii) institutions in charge of controlling over the use of state powers and (iii) legal consequences arising from the controlling over the use of state powers. The whole system operates to ensure the implementation and protection of human rights be carried out in a right and effective manner, and in doing so, it contributes to identifying and imposing strict sanctions against violations of human rights in the exercise of state powers. In order to enhance the role of this mechanism, it is necessary to understand fully and rightfully points of view adopted by the Party and the State, while implementing in a synchronized manner a host of solutions to ensure the protection of human rights. These solutions include: to develop and improve Party and the State’s power control mechanism; to enhance the supervision by the Vietnamese Fatherland Front, socio-political organizations and the people over the operation of state agencies; and, last but not least, to encourage the role of the mass media in ensuring the implementation and protection of human rights in Vietnam.
