Artificial intelligence contributes to improving economic efficiency and benefits, but at the same time poses risks to privacy and personal data protection. The ability to foster technological innovation while prioritizing user rights will be a clear challenge as Vietnam strengthens its position in the global digital economy. Based on international experiences, this article offers some recommendations to improve Vietnam's legal framework on privacy and personal data protection.

After more than 19 years of implementation, the 2006 Law on Civil Aviation of Vietnam (amended and supplemented in 2013, 2014, 2023, 2024) has been effective in regulating social relations arising in the field of civil aviation. However, in addition to the advantages achieved, in the implementation process, the Law on Civil Aviation of Vietnam has also revealed many limitations and shortcomings. Implementing the provisions of the Law on Promulgation of Legal Documents 2025 (amended and supplemented in 2025), Resolution No. 77/2025/UBTVQH15 dated April 21, 2025 of the National Assembly Standing Committee on adjusting the 2025 Legislative Program, the new Draft Law on Civil Aviation of Vietnam has been developed by the Government and submitted to the National Assembly for consideration. The article analyzes a number of legal issues in the Draft Law on Civil Aviation of Vietnam to make recommendations for improving legal regulations.

Through an analysis of the current situation and a comparison with international experience, this paper evaluates the Draft Law Amending and Supplementing a Number of Articles of the Law on Geology and Minerals. The assessment reveals that while the Draft introduces positive adjustments in administrative procedures and licensing, it still fails to address core reforms in financial policy. Consequently, the paper proposes key solutions to be incorporated into the Draft, including: (i) Consolidating existing financial obligations into a unified and flexible mechanism; (ii) Revising the tax calculation method to incentivize deep processing through specific incentives; (iii) Improving the licensing auction mechanism towards multi-criteria evaluation; and (iv) Enhancing transparency and accountability. These recommendations are expected to create changes, transforming Vietnam’s mining sector from raw material exports to mastering the value chain, ensuring sustainable development and optimizing national benefits.

Reproduction and quotation constitute the two most common and serious infringements of copyright, particularly with respect to literary works. The Draft Law amending and supplementing a number of provisions of the Law on Intellectual Property currently include a clause permitting "the use of lawfully published text and data that are publicly accessible for the purpose of research, training, and the development of artificial intelligence (AI) systems." However, specifying only the purpose of use without clearly defining which are legally permissible may lead to difficulties in practical application. This article analyzes the orientation for improving Vietnam's intellectual property legislation regarding these two acts, drawing upon the experience of jurisdictions which have taken earlier steps in this field, with a view to establish a fair and more appropriate legal framework for authors and co-authors. Accordingly, it aims to foster creative activities in the context of digital transformation and the rapid development of artificial intelligence.

The rapid development of e-commerce affirms the crucial role of the State in policy making and building legal frameworks for the digital economy. Two key aspects of international practice are: (i) developing policies to support digital service providers and (ii) putting in place a thorough, well-thought-out legal framework to control e-commerce. However, Vietnam’s current legal framework, especially on dispute resolution mechanism, have lagged behind the market accelerated development. The paper analyzes Vietnam’s e-commerce legal framework based on comparison with international experiences, focusing on the dispute resolution regime proposed in the forthcoming E-commerce Law. The study identifies significant gaps and challenges in balancing consumers’ rights, legitimate interests of the State in regulating e-commerce, and businesses’ flexibility using a comparative and doctrinal approach references some developed jurisdictions. The study argues that the upcoming E-commerce Law should place effective dispute resolution regime, prioritizing mechanisms that not only protect consumers on digital economy but also enhance legal certainty and promote international integration.

This article provides a comparative analysis of three representative models of AI governance: the European Union’s detailed risk-based regulatory framework, Japan’s policy-oriented fundamental law, and the United Kingdom’s principles-based governance model. It offers several recommendations for Vietnam in designing the Law on Artificial Intelligence that is both flexible and capable of ensuring effective risk control, thereby contributing to the realization of the spirit of Resolution 66-NQ/TW on the “breakthrough of breakthroughs” in institutional reform. The study emphasizes that Vietnam’s forthcoming Law on Artificial Intelligence should be constructed to evolve alongside technological advancement rather than lag behind it.
