COPYRIGHT PROTECTION FOR WORKS CREATED BY AI
Abstract
Copyright is the right of an organization or individual to create or own a work (Clause 2, Article 4 of the Law on Intellectual Property, amended and supplemented in 2022 (IP Law)). In the current era of digital development, the exploitation of works – the subject of copyright –can be said to occur every hour. At the same time, copyright needs to be protected to prevent illegal exploitation. However, whether works created by artificial intelligence (AI) are protected like those created by humans remains controversial. This article analyzes and evaluates current intellectual property regulations and the status of AI in creating works, thereby proposing solutions to improve the legal framework to better align with the Fourth Industrial Revolution.
