Abstract
In the digital era, "digital legacy" has become an inseparable part of an individual’s assets and personality rights. The enactment of the Law on Personal Data Protection 2025 marks a significant milestone, establishing the highest legal framework for privacy protection in Vietnam. However, enforcing these provisions for deceased individuals still poses numerous challenges in terms of legal interpretation and application. This article focuses on analyzing the new 2025 legal framework, benchmarking it against pioneering international models: France’s postmortem privacy protection, the United States’ digital asset fiduciary access, and Germany’s contractual inheritance. Consequently, the author evaluates the compatibility of the current Law and proposes an enforcement mechanism based on a "hybrid model" and a "priority hierarchy system." These recommendations aim to refine sub-law regulations to ensure respect for the deceased’s will, protect the legitimate rights of heirs, and provide transparency for digital service providers.
