Notarisation of business records - Legal experience of some countries in the world and suggestions for Vietnam
Abstract
Notarisation of business records is an essential activity in the process of establishing and developing a company, which contributes to promoting trust and safety in many traditional and modern transactions. However, in Vietnam, transactions or business records are not required to be notarised. The lack of authentication in business records can lead to disputes or be exploited by criminals to create falsified records to commit illegal acts. Therefore, it is necessary to stipulate mandatory notarisation of business records with the dual goal of promoting the role of notarisation and synchronising with relevant legal provisions. The article studies the legal experience of the United States, Belgium, Indonesia, and the European Union on notarising business records. On the basis of selective inheritance, the article aims to make recommendations to improve the law on notarisation of business records in Vietnam in the coming time.
