Some issues adjusted by legislation relate to Vietnam Asset Management Company of credit institutions in Vietnam and the lesson from China

Abstract

The article mentions two important legal issues to VAMC are organization and operation of it. Organizational issues
of VAMC are studied, reviewed in three aspects: Firstly, the legal position and the legal favour for VAMC; secondly,
representative agency of owner, the state management mechanism for VAMC; thirdly, funds which VAMC use to handle
bad debt. Operational issues of handling bad debts are researched, considered in two sides: Firstly, applying methods
of purchasing debt (purchasing debt in accordance with policy and purchasing debt in accordance with market prices);
secondly, mobilizing private capital, foreign capital into the handling of bad loans & guarantee asset and VAMC role in
shaping and building debt trading market
