Compelting the law on handling security assets in order to protect the interests of credit institutions

Abstract

 The law on handling security assets in lending activities of credit institutions is a tool to ensure the harmonization of interests of entities involved in the handling of security assets. However, the reality in the operation of credit institutions recently shows that the interests of credit institutions are affected due to the existence of the problem of handling security assets, including the lack of legal content; many current regulations on handling security assets are not appropriate, asynchronous, conflict with the relevant provisions of Civil Code 2015, causing difficulties and greatly affecting the handling of security assets. Based on the point of view of protecting the rights of credit institutions, the article focuses on analyzing three issues that need to be completed in the law on the handling of security assets in lending activities of credit institutions in VietNam at present, includes: i) Completing the legal framework on security property handling; ii) Completing the principle of handling collateral; iii) Completing some specific regulations on handling collaterals.
