Towards the harmonization of contract law: Ensuring coherence between the 2019 Labor Code and the 2015 Civil Code

Abstract

This article builds upon the fundamental principles of civil law and conducts a comparative analysis of specific provisions in the 2015 Civil Code and the 2019 Labor Code to identify key inconsistencies in contractual regulations. Through this examination, the paper highlights areas where a lack of coherence undermines legal clarity and practical enforcement. It then proposes solutions to refine and harmonize contract law, thereby reaffirming the Civil Code's central position in Vietnam's legal system while preserving the unique characteristics and protective function of labor law.
