Labor law on termination of employment contracts by employers – Current situation and some recommendations for improvement

Abstract

Termination of employment contracts is among the most crucial and sensitive issues in labor law, as it directly affects employees' livelihoods and employers' management and business rights. Although the current Labor Code provides fairly comprehensive provisions on grounds and procedures, several limitations persist in practice, including vague criteria, overlapping regulations, and insufficient transparency. These shortcomings heighten the risk of disputes and compromise employees' lawful rights. Therefore, analyzing the current legal framework, identifying deficiencies, and proposing improvements are essential to ensuring a fair balance of interests, enhancing transparency and predictability, and fostering a more harmonious, stable, and progressive labor relationship.
