Discussion on the independence of the administrative body for competition in relationship with the administrative body for industry management in Vietnam today

Abstract

Improving the efficiency of competition law and policy enforcement requires many synchronous solutions, but the main issue is overcoming the competition authority's lack of independenceAccording to the article, the competition authority must be able to limit the practice of lobbying by industry regulators, as well as limit the ability of industry regulators to intervene through the issuance of administrative documents. The article also analyzes the shortcomings and inadequacies in the law's provisions as well as the competition authority's organization and operation model, and proposes ideas to ensure an independent and fully authorized legal position, as well as transparency about the competition authority's organization and operation mechanism in Vietnam today.
