Current status of land use rights and housing ownership rights of foreign individuals in Vietnam

Abstract

Trong xu thế phát triển, hội nhập chung, Việt Nam trở thành điểm đến của người nước ngoài từ các quốc gia trên thế giới đến sinh sống, làm việc và du lịch. Trước bối cảnh đó, nghiên cứu thực hiện đánh giá thực trạng về quyền sử dụng đất, quyền sở hữu nhà ở của cá nhân nước ngoài tại Việt Nam. Nghiên cứu sử dụng các phương pháp phổ biến gồm phương pháp thu thập dữ liệu và phương pháp phân tích dữ liệu. Kết quả nghiên cứu đã đánh giá quy định pháp luật từ trước đến nay về quyền sở hữu nhà ở gắn liền với đất ở đối với cá nhân nước ngoài; đánh giá thực tiễn khi triển khai thực hiện các quy định nhằm chỉ ra các tồn tại. Trên cơ sở đó nghiên cứu đề xuất một số kiến nghị nhằm hoàn thiện chính sách về quyền sở hữu nhà ở của các cá nhân nước ngoài tại Việt Nam.

Abstract

In the trend of development and integration, Vietnam has become a destination for foreigners from countries from around the world to live, work and travel. In that context, the study assesses the current status of land use rights and housing ownership rights of foreign individuals in Vietnam. The study employs common methods including data collection and data analysis. The research results have evaluated the legal regulations up to now on home ownership rights attached to land for foreign individuals; evaluating the practice when implementing the regulations to point out the shortcomings. On that basis, the study proposes a number of recommendations to improve the policy regarding housing ownership rights of foreign individuals in Vietnam.
