DISCUSSION ON THE WARNING PUNISHMENT IN THE CRIMINAL CODE 2015

Abstract

The warning is the lightest main punishment in Vietnam’s punishment system. The warning has outstanding advantages, such as not depriving or restricting convicts’ freedom; convicts are not isolated from society, etc. Advantages are based on always clearly showing that the unified policy can show humanity, orients to the good and continues to be the development trend of Vietnam’s criminal law. Through the study of legislative techniques and the survey of judicial practice in Vietnam, it was found that the formulation of regulations and the application of this penalty revealed many limitations. The article presents the author’s point of view and discusses and recommends suggestions for more practical application of the warning penalty.
