SEVERAL LEGAL ISSUES ABOUT PROTECTING PRIVACY RIGHTS IN MARRIAGE AND FAMILY RELATIONS

Abstract

The right to privacy is a fundamental human right that has been recognized and protected in international and regional instruments and is internalized in national law. However, with the rapid development of information technology and social networking, infringements in privacy occur more frequently and commonly. Especially, they takes place in the relationship between spouses, parents and children when the management of information, telephone, correspondence or the sharing of information on social networks among members of the family. Family takes place on a regular basis. From a legal point of view, all of these behaviors may be an infringement of the individual's right to privacy even if they are family members. However, Vietnamese laws do not yet have any specific regulations to adjust in this regard. The article analyzes some legal issues about the protection of privacy in a family-to-family relationship and proposes some improvement solutions.
