THE PROTECTION OF TRADITIONAL KNOWLEGDE IN CHINESE AND INDIAN LAWS – APPLYING THE EXPERIENCES IN VIETNAM

Abstract

It has been recognized that traditional knowledge has been researched and exploited by the international community for decades. Many countries have found that traditional knowledge is very easy to be appropriated and illegally exploited. Therefore, finding tools for protecting the traditional knowledge of the nation are facing many difficulties. In Vietnam, traditional knowledge is being used and exploited at the reference level, not to mention protection. This paper explores the exploitation and protection of traditional knowledge in accordance with the laws of China and India. The experiences are applied in accordance with Vietnam's intellectual property laws.
