DIFFICULTIES IN THE IMPLEMENTATION OF REGULATIONS ON COURT FEES IN JUDICIAL PRACTICE

Abstract

Civil court fees is defined as a sum of money that shall be paid in advance to the State Budget by the involved parties when the Court resolves a civil case and is enforced when the judgment or decision of the Court takes legal effect. In trial practice, a number of judgments have been canceled or modified due to violations in calculating court fees. In fact, there are still many views and different interpretations in the application of the provisions of law on determination of court fees.. Through the article, we point out some practical situations where the awareness is not uniform, then suggesting our personal views and some recommendations for the law on court fees in civil cases.
