SOME INADEQUACIES OF THE LAW ON EXCLUDING LIABILITY FOR DAMAGES CAUSED BY BREACH OF OBLIGATIONS IN COMMERCIAL CONTRACTS

Abstract

Exclusion of liability for damage caused by breach of contractual obligations is agreed upon by the parties or the law provides for grounds for eliminating liability for damage caused by which the breaching party has caused damage shall not be subject to the restoration of a part or the entire of the original condition of the property to the aggrieved party. The article mentions the legal nature of excluding liability for damages caused by breach of obligations in commercial contracts; some inadequacies of the law with regard to this legal content, and give directions for perfecting the law.
