IDENTIFY SOME PRINCIPLES OF CONDUCTING PENALISATION IN THE VIETNAM CRIMINAL CODE

Abstract

The penalization of behaviors that are dangerous to society is an issue which is always set out in the process formulating and completing the criminal policy on punishment. To ensure the suitability of the punishment policy with the request for protection of human rights, with the development conditions of the country in politics, economy, culture, society as well as with the world’s general development trend, lawmakers always have to follow certain principles when conducting penalization. This article studies and clarifies some basic principles when conducting penalization in the Vietnamese Criminal Code.
