RIGHT OF REPRODUCTION AND CITATION OF WORKS IN THE EDUCATIONAL FIELD
Abstract
According to IP Law, the copyright owner has the exclusive rights to reproduce the copyrighted work and has the right to authorize or prevent others from making copies. However, in certain cases the copyright holders are not entitled to prevent others from copying. Besides, reasonable quoting from other authors’ works to comment on or illustrate one's works is authorized by law. The recognition of these exceptions of copyright is the progressive development of the Vietnam Intellectual Property Law. Even so, there are many issues to discuss on this topic. In this article, the author analyzes the provisions of the Vietnamese Intellectual Property Law relating to the right to make a copy and to quote a work in the educational field and proposes the direction of improvement based on the experience from France, the United States, and some other countries.
