THE CHOICE OF LAW AND BURDEN TO PROVE THE CONTENTS OF FOREIGN LAW IN PRIVATE INTERNATIONAL LAW IN VIETNAM

Abstract

 The choice of law and application of foreign laws in the settlement of civil cases involving foreign elements are being implemented in many countries around the world. The new Civil Procedure Code and Civil Code year of 2015 has added some provisions related to the application of foreign laws and the burden to prove the content of foreign laws of the parties involved. However, the lack of detailed instruction regulations and the limitation of trial experiences are making difficult for judicial activities.
