THE COMPETENCE TO APPLY REMEDIAL MEASURES IN THE LAW ON HANDLING OF ADMINISTRATIVE VIOLATIONS

Abstract

Sanctioning of administrative violations is seen as an effective solution to fight and prevent administrative violations. In addition to the application of sanctioning forms to deter individuals and organizations from committing administrative violations, the law also applies certain measures to overcome the consequences of administrative violations. In order for the application of remedies, the person who sanctioning must have full competence as prescribed by law. This article analyzes the competence to the application of remedies in the law on handling of administrative violations, pointing out some inadequacies and making some proposals for improvement.
