VACCINE INJURY COMPENSATION IN THE UNITED SATES – RECOMMENDATIONS FOR VIETNAM

Abstract

Vaccines are one of the optimal methods to prevent diseases and epidemics, but they also have many potential health risks when injected. Compensation liability for damage caused by vaccines has been of interest in many countries, including the United States. The federal government has implemented two vaccination incident compensation programs: The National Vaccine Injury Compensation Program (VICP) and The Countermeasures Injury Compensation Program (CICP). Meanwhile, in Vietnam, liability to compensate for vaccine damage is stipulated in the Civil Code 2015, Law on State Compensation Liability 2017 and Decree No. 104/2016/ND-CP on vaccination. This article will study these programs and propose some recommendations for vaccine injury compensation in Vietnam.
