IMPROVING THE DRAFT OF LAND LAW ON EXCHANGE, TRANSFER AND AGRICULTURAL LAND BANK

Abstract

Land Law No. 45/2013/QH13 was approved by 13th National Assembly, at 6th session on November 29, 2013. Resolution No. 19-NQ/TW summarized that after nearly eight years of implementation, the Land law 2013 has achieved important outcomes and effective use of land. However, with regard to practical implementation, many issues need further studied for amendment and supplement. To overcome these limitations and shortcomings and in the spirit of Resolution No. 18-NQ/TW on perfecting institutions, policies and laws on land, Government Proposal No. 307/TTr-CP dated 07 September 2022 was submitted to the National Assembly the draft Land Law (amended). Within the scope of this article, the author lists, analyzes, offers and exchanges ideas on a number of legal issues of the Draft Land Law (amended) on the conversion, transfer, and agricultural land bank, thereby proposing recommendations to improve legal regulations.
