SETTLEMENT OF CONSEQUENCES OF JUDGMENT ENFORCEMENT FOR LEGALLY EFFECTIVE JUDGMENTS OR DECISIONS ANNULLED ACCORDING TO CASSATION OR REOPENING PROCEDURES

Abstract

Currently, the re-settlement of first-instance civil cases after a cassation or reopening decision which is issued to annul legally effective judgments and decisions often gives rise to new circumstances, such as the Court must deal with the consequences of judgment enforcement and other related issues. For this matter, the Judge must verify and collect evidences at the Civil Judgment Enforcement Agency, take testimonies of the involved parties about the results of previous judgment enforcement, the court fee advances of the involved parties whether or not it has been handled... to serve as a basis for the settlement of the case. However, in practice in recent years, the resolution of these issues has arisen some problems and inadequacies.
