PROTECT THE RIGHT TO PROPERTY OF THE THIRD PARTY IN THE TRANSACTION RELATED TO THE COMMON PROPERTY OF HUSBAND AND

Abstract

The Law on Marriage and Family 2014 prescribed the protection of property rights of third party in good faith in transactions related to common property of husband and wife. However, this issue still has certain limitations through practically applying the law, especially the protection of the interests of third party in good faith in transactions related to bank accounts, securities accounts, property that husband and wife put into common business activities; transactions made with common property to meet the family's essential needs, or transactions from common property that husband and wife select the agreed property regime. Within the scope of this article, the author focuses on analyzing and pointing out the shortcomings of the current Vietnamese law on this issue, thereby proposing some recommendations to perfect the law to protect the legitimate interests of third parties in good faith in civil transactions related to the common property of husband and wife.
