Abstract

State of emergency (“State of emergency”, “State of exception”, “State of alarm” or “State of siege”) is a concept that has long been used in many countries under all political regimes. This is considered a state in which the government of a country is allowed to take measures that affect society without being applied under normal circumstances. Firstly, this article analyzes the issues of emergency in the Constitution and legislation of the French Republic, as well as some regulations that France has implemented in response to the COVID-19 pandemic. Next, the author summarizes several suggestions to improve the Vietnamese law on the state of emergency.
