THE APPLICATION OF FAIRNESS IN THE COURT ADJUDICATION IN UK, FRANCE AND SUGGESTIONS FOR VIETNAM

Abstract

Applying fairness in the trial of the Vietnamese Court today still faces problems that need further researched and perfected both in theory and in law. In the world, the application of fairness in the adjudication activities of common law countries is strongly influenced by the approach of the British Court, while the view on fairness and its application to the activities of the judicial authorities in France has a great influence and impact on civil law countries. The article focuses on analyzing the following main issues: (1) Applying fairness in adjudication activities in England and France; (2) Practical application of fairness in the trial activities of the Court today in Vietnam and recommendations and proposals.
