De Minimis doctrine in competition law in Vietnam – Comparision to European Union

Abstract

De Minimis refers to a principle that allows the Court to ignore or refuse to consider trivial and insignificant issues. In competition law, this allows competent authorities are able to ignore anti-competitive agreements where the parties have a market share below a certain threshold. In Vietnam, De Minimis was first transplanted in Decree 35/2020/ND-CP detailing a number of articles of the Competition Law. The following article discusses De Minimis principle in Vietnam competition law, in comparison with the European Union (EU) competition law – one of the regions with the most developed competition laws in the world.
