Abstract

In the process of reforming Vietnam's legal system, enhancing the law on commercial arbitration, and recognizing and enforcing foreign arbitral awards, Vietnam aims to effectively implement the international commitments it has agreed to. Although Vietnam has made significant efforts, such as the introduction of the Commercial Arbitration Law in 2010, the legal provisions for recognizing and enforcing foreign arbitral awards still have limitations. This article examines the grounds upon which a party, subject to an arbitral award, often relies to object to its recognition and enforcement, especially when the arbitration agreement is deemed invalid under the law that both parties agreed to apply.
