Abstract

The article examines the issues with the requirements of the Land Law 2013 concerning the treatment of bad debts secured by land use rights in the context of Vietnam Asset Management Company (VAMC). Specifically, the article points out the problems in transferring the mortgagee's rights after conducting destructive debt trading activities from credit institutions. Difficulties in applying methods for handling land use rights as mortgaged assets of real estate business projects because land law only recognizes that the mortgagee of land use rights is an economic organization. The lack of regulations on auctioning collateral assets that are land use rights is also considered in the article. This research then recommends how the current Land Law should be strengthened  through amendments.
