Vietnam’s legislation on anti-domestic violence

Abstract

Domestic violence in its varied forms occurs in all parts of the world. It is an act unacceptable in our contemporary society, because it violates the rights and trespasses dignity of human beings, jeopardizes the ethics and good practices in communities. Being fully aware of the need to promote the anti-domestic violence work, the Party and Government of Vietnam have adopted a wide range of legal documents directly and indirectly related to domestic violence prevention and control, including the Law on Domestic Violence Prevention and Control proclaimed by the 12th National Assembly on 21 November 2007 and entered into effect on 1 July 2008. The adoption of the Law demonstrated a further positive step in the building of a socialist rule-of-law state, reflecting the continuity to perfectionate a legal system aimed at guaranteeing human rights of Vietnamese people.

The author in this article explores peculiar regulations set forth in the Law on Domestic Violence Prevention and Control; challenges may be faced in implementing those regulations. Finally, she proposed certain solutions and measures to be undertaken to materialize the Law in reality.
