Determination entity responsible for compensation on damages of minors: current situation and solutions

Abstract

Liability for compensation of minors (TNBTTHCNCTN) is applied to the subject causing minor damage, and according to regulations, compensation liability arises. Determining the entity causing the damage is not too difficult. Still, the issue of determining the entity responsible for compensation is an obstacle when the 2015 Civil Code stipulates that there are still many problems. For example, how is compensation handled for a minor under 15 years old who is causing damage and has no parents, guardians, or personal property? On the other hand, the 2015 Civil Code has "forgotten" the school's responsibility when minors from 15 years old to under 18 years old cause damage while studying and under school supervision. If the school is at fault while supervising and educating minors and causing damage, then the 2015 Civil Code does not stipulate their responsibility. Therefore, continuing to add legal terms, amend and supplement some legal regulations, and ensure the principles of equality, strictness and fairness of the law related to NCTHCNCT is urgent work.
